Sexual Assault Charges Dropped Against Hilary Duff's Ex-Husband Mike Comrie

Ryan Parry of the Daily Mail reported in March that Comrie, the ex-husband of singer Hilary Duff, submitted a DNA sample for testing during the investigation.

Prosecutors have decided NOT to charge former National Hockey League star Mike Comrie with rape, after confirming there was enough reasonable doubt coming from his accuser's story to make charges impossible to file.

Comrie was investigated for an alleged sexual assault at his Los Angeles home back in February.

Prosecutors said there was reasonable doubt as to whether Comrie's accuser consented to anal sex during a February incident in which Comrie invited two women to his L.A. home, for drinks - and sex.

The woman claims she told him to stop but he didn't - instead, he allegedly choked her and told her she couldn't tell him what to do.

The accuser had told police that she waited while Comrie had sex with the first woman, and after that woman left, the accuser and Comrie apparently had consensual sex. One of the unnamed females claims he had rough anal sex without her consent and slapped her in the face.

Investigators concluded that they couldn't determine beyond reasonable doubt that Comrie acted without the belief that he had consent, meaning the charges have now been dropped.

After that, the accuser is said to have gotten off the bed and began recording audio where she accused Comrie of sexual assault, TMZ reported.

The woman was reportedly examined at a rape treatment center but it couldn't be determined whether her injuries came from consensual or non-consensual sex. The former couple finalized their divorce in January of previous year.

The 36-year-old Canadian native and Duff share their 5-year-old son Luca.
