The Hennepin County Attorney's Office had received an extension to 4 p.m. on Friday to either file charges against the 42-year-old suspect from New Hope, or release him from jail.
As a result, the suspect was due to be released from jail Friday afternoon.
Immigration officials say they have taken a man who was accused of having sexual contact with a student in a Twin Cities high school into custody. Immigration and Customs Enforcement was informed and it is likely they will take him into custody, he said.
The department also says that at this time, there's no evidence that suggest the student planned to harm anyone at the school.
"What we have to determine the capacity of willingness of the student, even though he's a 19-year-old, to consent to sex", said Brooklyn Park Deputy Chief Mark Bruley.
Earlier, police said the man had a Washington state driver's license and travels around the country. The two later returned to the same bathroom to have sex again. School officials and the School Resource Officer investigated the report and determined the student had left school property.
Assistant Chief Bruley says the suspect exited the school and was trying to escape, but a group of adults made up of security personnel, teachers and administrators ran him down and tackled him following a short foot chase.
Dixon Police now have School Resource Officers assigned to Dixon High School and Reagan Middle School, and Chief Langloss said in a statement that helped them resolve the potentially unsafe situation.
